California Drunk Driving Punishment Aggravators
Certain circumstances surrounding your DUI arrest in San Diego can be called aggravating factor, or DUI Penalty enhancements, and make your crime or violation more severe in nature to the courts.

| A DUI arrest while driving with a minor passenger under 14 years of age in vehicle or vessel while Under the Influence of Drugs or Alcohol. | |
| Driving a vehicle or vessel with a blood alcohol level (BAC) of .15% or above will increase a DUI penalty compared to if the blood alcohol level were between .08% and .14.999% | |
| Any fourth or subsequent DUI arrest within a 10 year wash-out period will be charged as a felony, with or without aggravations. | |
| Receiving a DUI in, or after being observed in, a California Highway Safety Zone, including a school crossing zone. | |

| Reckless Driving and / or Speeding at or above 20 or more miles per hour above the posted or designated speed limit while driving under the influence, or more than miles per hour above the speed limit on a California Freeway or Interstate. | |
| Refusal to submit to a chemical test under California's "Implied Consent" law. | |
| A second or subsequent Drunk or Drugged Driving offense within the ten year washout period will be punished more severly than a first DUI offense within 10 years. | |
| Vehicle Impoundment or Sale as a Nuisance resulting from a DUI arrest and / or convicton. | |
| A DUI issued to a convicted felon; a prior felony within the previous ten years, from date of arrest to date of arrest, regardless of whether or not the previous conviction was drunk driving related or not, wiil promote a DUI crime to a felony charge. | |
| Infliction of Body Injury to another in the course of driving under the influence. | |
